Overview
<
The Week 3 Discussion provides you an opportunity to apply what you have learned this week to case scenarios. Please review the two case scenarios below. Then, choose one of the scenarios for your initial discussion board post and follow the posting requirements below to create an initial and two reply postings. Your initial post and at least two reply postings should be in compliance with the Expectations for Discussion Boards and Discussion Board Rubric. You must create and post your initial post before you will be able to see other postings.
<
<
Case Scenario #1
<
You are the Executive Director of Literacy First, a non-profit organization whose mission is to improve childhood literacy. On Friday afternoon, your Human Resources Director and Finance Manager stop by your office to share some news. They report they have discovered that Jesse Jones, an employee who recently resigned from Literacy First, made personal purchases using the company credit card. Jones was a school outreach coordinator, whose job included hosting meetings and events at local schools to promote Literacy First’s programs. Jones would regularly purchase food and products to give away during the meetings using a company credit card.
<
<
Jones, like most of Literacy First’s employees, began working at home during the COVID pandemic and transitioned to hosting meetings and events virtually. The HR Director explained that while employees were working remotely, they were permitted to have supplies shipped to their house instead of to the office. Jones continued to spend money on food and products while working from home, even though Jones was hosting virtual events, in an amount similar to what was spent during the time Jones was hosting live events. Jones’ supervisor did not question why Jones continued to incur these charges and did not follow up to confirm that Jones has provided original receipts or explanations and justifications for charges on the company purchasing card, as required by company policy.
<
<
The weeks after Jones left work at Literacy First, the Finance Manager was auditing the credit charges and raised concerns about the charges on Jones’ credit card. A preliminary investigation showed that Jones was orderings food for themselves and their family to eat and charging the expense to Literacy First’s credit card. There were also charges for apparel on the card that could not be traced to any giveaway or event. In total, the Finance Manager estimated Jones may have charged $2,376.42 in personal charges to the Literacy First credit card during Jones’ last six months of employment.
<
<
Frustrated with this development, you immediately start thinking about your options. You can’t fire Jones. Jones has already quit. You consider the facts and what you learned in your business law class.
<
<
Case Scenario #2
<
Pat Smith is an IT Security Specialist for a large e-commerce company. As part of their job, Pat routinely scans the company’s network for security threats and vulnerabilities. One day, Pat discovered a vulnerability in the company’s network that has resulted in customer credit card data being left unencrypted and at risk. When Pat checked out the vulnerability, Pat discovered that, sure enough, they were able to see customer credit card data. Company protocol requires Pat to immediately report the security issue to the company’s Chief Information Security Officer and to take steps to protect the data. However, Pat’s been disgruntled with their employer lately and thinks it would serve the company right to get some bad press. In Pat’s opinion, the company makes million off the backs of exploited workers and Pat is tired of it.
<
<
Instead of reporting the issue and taking actions to fix it, Pat decides to leak information about the vulnerability. Pat does not actually want any customers to lose money. Pat simply wants to create a public relations headache for the company. Pat assumes the issue can be elevated and the vulnerability patched before anything bad happens. Instead, as it turns out, a hacker learns of the information Pat shared, accessed the network to harvest the customer credit card data, and sold it on the dark web.
<
<
Posting Requirements
<
Choose one of the case scenarios above, then create an initial post by answering the questions posed for that case scenario. You should clearly identify which case scenario you are posting about at the beginning of the your post.
<
<
Initial post– at least 250 words
<
Questions for Case Scenario #1 (above):
<
<
Has Jones committed a crime? If so, which one(s)? Identify and discuss the elements of the crime(s).
<
Has Jones committed a tort? If so, which one(s)? identify and discuss the elements of the tort(s).
<
In your opinion, what should Literacy First do now? Explain.
<
Questions for Case Scenario #2 (above):
<
<
What crime(s) has (have) been committed in this scenario? By whom? Identify and discuss the elements of the crime(s).
<
What tort claim(s) might an affected customer have against the company? Explain your answer, with a discussion of the elements of the tort(s) you identify.
<
If you are advising the company about what they can do to prevent something similar from happening in the future, what do you tell them?
